KANSAS – According to the statement, the Supreme Court found there was no abuse of discretion on the part of the district court in denying those motions.
It also found there was no violation of his due process rights regarding disclosure of evidence.
Prosecutors alleged that he broke into a west Wichita apartment, choked a girl until she was unconscious, then took her to the balcony and raped her.
It took jurors about an hour to find Breitenbach guilty of attempted capital murder, rape, aggravated criminal sodomy and aggravated burglary. He acted as his own attorney.
He was sentenced in November 2018 to life in prison.
